Welcome to Violin With Marta. By accessing or using this platform, you agree to be bound by these Terms of Service. If you do not agree, please do not use the platform.
Violin With Marta is a violin education service operated by Marta Sembele, based in Calgary, Alberta, Canada. It provides free video lessons, one-on-one online lessons, in-person lessons in Calgary, and educational content for beginner to professional violin players.
1. Overview
These terms apply to all users of the Violin With Marta platform, including free and paid features. By creating an account, purchasing lesson packages, or using any part of the platform, you agree to these terms.
2. Payments & Billing
Online Lesson Packages
- 4 × 45-minute lessons - 230 CAD, one-time payment before lessons begin.
- 4 × 30-minute lessons - 170 CAD, one-time payment before lessons begin.
- Prices are shown in CAD, USD, or EUR and are charged in Canadian dollars.
- Lesson packages expire 45 days after purchase. All lessons must be booked and completed within this period.
In-Person Lessons (Calgary)
- In-person 4-lesson packages: 30 minutes (180 CAD), 45 minutes (240 CAD), or 60 minutes (300 CAD), one-time payment.
- In-person lessons begin after a free intro lesson and are arranged directly.
Price Changes
I reserve the right to change prices at any time. Any price changes will be communicated with at least 30 days notice. Price changes do not apply to lesson packages already purchased.

3. Your Account
- Your account is personal and non-transferable.
- You may not share your login credentials with others.
- You are responsible for all activity that occurs under your account.
- I reserve the right to suspend or terminate accounts that violate these terms.
4. Acceptable Use
When using the platform, including any messages you submit, you agree to:
- Be respectful in any communication with me and other users.
- Refrain from harassment, spam, or any form of inappropriate content.
- Use the platform lawfully and only for its intended purpose.
I reserve the right to remove content or suspend access for anyone who engages in disruptive or harmful behavior, at my sole discretion.
You agree not to make false, misleading, or disparaging statements about Violin With Marta or its content.
5. Intellectual Property
All content on the platform - including videos, lesson materials, written guides, images, and other educational materials - is my intellectual property and belongs to Violin With Marta.
- You may not copy, reproduce, distribute, or share any platform content outside of your personal use.
- You may not use platform content for commercial purposes.
- Screen recording, downloading, or redistributing video content is prohibited.
Your Content
If you submit content to me (such as messages, feedback, or testimonials), you keep ownership of that content. By submitting, you grant me a perpetual, non-exclusive, royalty-free, worldwide, sublicensable, and transferable license to host, display, store, reproduce, adapt, edit (for length, format, or clarity), and use the content in any media for any purpose related to operating, promoting, or selling the platform. Excerpts used in marketing will identify you by first name only unless you give written permission for more.
This license is subject to applicable data protection laws. Where your content contains personal data (such as your face, voice, or other identifying information) and those laws give you the right to request deletion or withdraw consent (for example under PIPEDA, GDPR, or UK GDPR), I will honor that request and stop using the relevant content within active marketing channels. Removal from materials already published or distributed offline cannot always be guaranteed, but I will make reasonable efforts. To make a request, please contact me.

6. Limitation of Liability & Disputes
Violin With Marta provides educational content and instruction. It is not professional career advice. Individual results vary based on personal practice, dedication, and aptitude.
- No warranties: the platform and all content are provided on an as-is and as-available basis. To the maximum extent permitted by law, I disclaim all warranties, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, uninterrupted availability, and non-infringement. While I do my best to help every student improve, progress depends on your own practice, consistency, and aptitude. No specific learning outcome is guaranteed.
- Force majeure: I am not liable for delays, failures, or interruptions caused by events outside my reasonable control, including illness, family emergencies, internet or power outages, third-party service downtime, natural events, pandemics, government action, strikes, or war. In these cases, I will make reasonable efforts to reschedule affected lessons. Where no reasonable rescheduling is possible, I will refund unused fees in good faith, subject to applicable consumer protection law.
- Liability cap: Except as set out below, my total liability to you for any claim arising out of or related to these terms or the platform is limited to the total fees you have paid to me in the 12 months before the event giving rise to the claim.
- Physical health: Violin playing involves physical movement. You are solely responsible for your own physical wellbeing during and between lessons. Violin With Marta is not liable under any circumstances for physical discomfort, strain, repetitive stress injury, or any other health issue arising from violin practice or from following lesson instruction. If you experience pain or discomfort, stop practicing and consult a healthcare professional.
- Instruments and equipment: You are solely responsible for your violin, bow, and all accessories and equipment at all times. Violin With Marta is not liable under any circumstances for damage to, or loss of, your instrument or equipment arising during or as a result of lessons, whether online or in person.
- In-person property: During in-person lessons at your home or another location you provide, you accept full responsibility for ensuring the lesson space is safe and suitable. Violin With Marta is not liable under any circumstances for any property damage, loss, or personal injury occurring at the lesson location.
- Digital and devices: Violin With Marta is not liable under any circumstances for technical issues, data loss, malware, security incidents, or any other damage affecting your personal devices or accounts in connection with online lessons or use of the platform.
- Carve-outs: Nothing in these terms limits or excludes liability for: gross negligence, willful misconduct, fraud, death or personal injury caused by my negligence, intellectual property infringement, breach of statutory duties relating to the security of personal information, or any other liability that cannot be limited or excluded by applicable law.
- Dispute resolution: If you have a dispute, please attempt to resolve it directly by contacting me first.
- Mediation: If I cannot resolve the dispute directly, it will be referred to mediation in Calgary, Alberta, Canada.
- Governing law: These terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein.
7. General Provisions
Indemnification
You agree to defend, indemnify, and hold harmless Violin With Marta and Marta Sembele from any claims, damages, losses, costs, or expenses (including reasonable legal fees) arising from your use of the platform, your violation of these terms, your violation of any rights of another person or party, or any content you submit to the platform.
Termination
I may suspend or terminate your account at any time for any breach of these terms, including but not limited to disruptive behavior on the platform, fraudulent chargebacks, sharing of login credentials, or unauthorized distribution of platform content. On termination for cause, you are not entitled to a refund of fees paid, your access to the platform ends immediately, and you must stop using any platform content. You may also close your own account at any time by contacting me.
Notice
Any notice required under these terms will be sent by email to the address associated with your account. You agree to send any notice to me via my contact page. Notice is considered delivered one business day after it is sent.
Assignment
I may assign or transfer these terms, in whole or in part, to a successor or affiliate in the event of a sale, merger, or restructuring of the business, without your consent. You may not assign or transfer these terms or your account to anyone else.
Severability
If any provision of these terms is found to be unlawful or unenforceable, that provision will be modified to the minimum extent necessary or removed, and the remaining provisions will continue in full force and effect.
Entire Agreement
These Terms of Service, together with the Privacy Policy and Refund Policy, constitute the entire agreement between you and Violin With Marta regarding your use of the platform. They supersede any prior agreements, understandings, or representations, whether written or oral.
Waiver
My failure to enforce any provision of these terms is not a waiver of my right to enforce that provision later. No waiver of any term will be effective unless given in writing.
8. Changes to These Terms
I may update these Terms of Service from time to time. If I make material changes, I will notify you by email. Continued use of the platform after changes take effect constitutes acceptance of the updated terms.
