Welcome to Violin With Marta. By accessing or using this platform, you agree to be bound by these Terms of Service. If you do not agree, please do not use the platform.
Violin With Marta is an online violin education platform operated by Marta Sembele, based in Calgary, Alberta, Canada. It provides video lessons, a learning community, private lesson packages, and educational content for beginner to professional violin players.
1. Overview
These terms apply to all users of the Violin With Marta platform, including free and paid features. By creating an account, subscribing to the community, purchasing lesson packages, or using any part of the platform, you agree to these terms.
2. Payments & Billing
Community Membership
- The community is billed at $19 per month (USD).
- New members receive a 7-day free trial. If you cancel during the trial, you will not be charged.
- After the trial, your subscription auto-renews monthly until cancelled.
Private Lessons
- 4 × 45-minute sessions - $200 (USD), one-time payment before lessons begin.
- 4 × 30-minute sessions - $160 (USD), one-time payment before lessons begin.
- Lesson packages expire 45 days after purchase. All sessions must be booked and completed within this period.
Price Changes
I reserve the right to change prices at any time. Any price changes will be communicated with at least 30 days notice. Price changes do not apply to lesson packages already purchased.

3. Your Account
- Your account is personal and non-transferable.
- You may not share your login credentials with others.
- You are responsible for all activity that occurs under your account.
- I reserve the right to suspend or terminate accounts that violate these terms.
4. Community Rules
The Violin With Marta community is a supportive space for learning. All members are expected to:
- Be respectful and supportive of other members.
- Refrain from harassment, bullying, spam, or any form of inappropriate content.
- Keep discussions constructive and on-topic.
I reserve the right to remove any member who engages in disruptive or harmful behavior, at my sole discretion. Removed members are not entitled to a refund for the current billing period.
Members agree not to make false, misleading, or disparaging statements about Violin With Marta, its content, or its community members.
5. Intellectual Property
All content on the platform - including videos, lesson materials, community posts by me, written guides, images, and other educational materials - is my intellectual property and belongs to Violin With Marta.
- You may not copy, reproduce, distribute, or share any platform content outside of your personal use.
- You may not use platform content for commercial purposes.
- Screen recording, downloading, or redistributing video content is prohibited.
Your Content in the Community
When you post in the community (text, photos, audio, video, comments, or any other content), you keep ownership of your content. By posting, you grant me a perpetual, non-exclusive, royalty-free, worldwide, sublicensable, and transferable license to host, display, store, reproduce, adapt, edit (for length, format, or clarity), and use the content in any media for any purpose related to operating, promoting, or selling the platform. Excerpts used in marketing will identify you by first name only unless you give written permission for more.
This license is subject to applicable data protection laws. Where your content contains personal data (such as your face, voice, or other identifying information) and those laws give you the right to request deletion or withdraw consent (for example under PIPEDA, GDPR, or UK GDPR), I will honor that request and stop using the relevant content within active marketing channels. Removal from materials already published or distributed offline cannot always be guaranteed, but I will make reasonable efforts. To make a request, please contact me.

6. Limitation of Liability & Disputes
Violin With Marta provides educational content and instruction. It is not professional career advice. Individual results vary based on personal practice, dedication, and aptitude.
- No warranties: the platform and all content are provided on an as-is and as-available basis. To the maximum extent permitted by law, I disclaim all warranties, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, uninterrupted availability, and non-infringement. While I do my best to help every student improve, progress depends on your own practice, consistency, and aptitude. No specific learning outcome is guaranteed.
- Force majeure: I am not liable for delays, failures, or interruptions caused by events outside my reasonable control, including illness, family emergencies, internet or power outages, third-party service downtime, natural events, pandemics, government action, strikes, or war. In these cases, I will make reasonable efforts to reschedule affected sessions. Where no reasonable rescheduling is possible, I will refund unused fees in good faith, subject to applicable consumer protection law.
- Liability cap: Except as set out below, my total liability to you for any claim arising out of or related to these terms or the platform is limited to the total fees you have paid to me in the 12 months before the event giving rise to the claim.
- Carve-outs: Nothing in these terms limits or excludes liability for: gross negligence, willful misconduct, fraud, death or personal injury caused by my negligence, intellectual property infringement, breach of statutory duties relating to the security of personal information, or any other liability that cannot be limited or excluded by applicable law.
- Dispute resolution: If you have a dispute, please attempt to resolve it directly by contacting me first.
- Mediation: If I cannot resolve the dispute directly, it will be referred to mediation in Calgary, Alberta, Canada.
- Governing law: These terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein.
7. General Provisions
Indemnification
You agree to defend, indemnify, and hold harmless Violin With Marta and Marta Sembele from any claims, damages, losses, costs, or expenses (including reasonable legal fees) arising from your use of the platform, your violation of these terms, your violation of any rights of another person or party, or any content you submit to the platform.
Termination
I may suspend or terminate your account at any time for any breach of these terms, including but not limited to disruptive behavior in the community, fraudulent chargebacks, sharing of login credentials, or unauthorized distribution of platform content. On termination for cause, you are not entitled to a refund of fees paid, your access to the platform ends immediately, and you must stop using any platform content. You may also close your own account at any time by contacting me.
Notice
Any notice required under these terms will be sent by email to the address associated with your account. You agree to send any notice to me by email at hello@violinwithmarta.com. Notice is considered delivered one business day after it is sent.
Assignment
I may assign or transfer these terms, in whole or in part, to a successor or affiliate in the event of a sale, merger, or restructuring of the business, without your consent. You may not assign or transfer these terms or your account to anyone else.
Severability
If any provision of these terms is found to be unlawful or unenforceable, that provision will be modified to the minimum extent necessary or removed, and the remaining provisions will continue in full force and effect.
Entire Agreement
These Terms of Service, together with the Privacy Policy and Refund Policy, constitute the entire agreement between you and Violin With Marta regarding your use of the platform. They supersede any prior agreements, understandings, or representations, whether written or oral.
Waiver
My failure to enforce any provision of these terms is not a waiver of my right to enforce that provision later. No waiver of any term will be effective unless given in writing.
8. Changes to These Terms
I may update these Terms of Service from time to time. If I make material changes, I will notify you by email. Continued use of the platform after changes take effect constitutes acceptance of the updated terms.
